1. Acceptance of Terms

These Terms of Service ("Terms") govern your access to and use of the website located at lumiform.ca (the "Site") and the permanent LED architectural lighting products and installation services (the "Services") offered by Lumiform ("Lumiform," "we," "us," or "our"). By accessing the Site, requesting a quote, or engaging Lumiform for Services, you ("you," "Customer," or "Client") agree to be bound by these Terms. If you do not agree to these Terms, please do not use the Site or engage our Services.

2. Description of Services

Lumiform designs, sells, and installs permanent, app-controllable LED architectural lighting systems on residential rooflines and exteriors. Services may include an initial consultation, a written quote or proposal, installation of lighting fixtures and associated wiring/control hardware, and ongoing access to a mobile application for controlling installed lighting. Specific scope, materials, and pricing for any individual project are governed by the signed quote, proposal, or work order for that project ("Project Agreement"), which forms part of the agreement between you and Lumiform alongside these Terms. In the event of a conflict between these Terms and a Project Agreement, the Project Agreement controls with respect to the specific project it covers.

3. Use of This Website

You agree to use the Site only for lawful purposes and in a manner that does not infringe the rights of, restrict, or inhibit anyone else's use of the Site. You may not attempt to gain unauthorized access to the Site, its servers, or any connected systems; interfere with the Site's operation; or use automated means (bots, scrapers) to extract content without our prior written consent. We may suspend or restrict access to the Site, in whole or in part, at any time and without notice.

4. Quotes & Estimates

Quotes provided through the Site, the Contact form, or in person are estimates based on the information available at the time and are not final until confirmed in a written Project Agreement following an on-site assessment. Final pricing may vary based on roofline length, material selection, electrical requirements, structural conditions discovered during assessment or installation, and permit or homeowners'-association requirements. Quotes are valid for [30 days / insert validity period] from the date issued unless otherwise stated.

5. Scheduling & Site Access

Installation dates are scheduled in advance and may be affected by weather, daylight, and prior project delays; Lumiform will make reasonable efforts to communicate any changes in a timely manner. You agree to provide safe, reasonable access to your property — including roof, attic, and exterior electrical points as applicable — for the duration of the installation. You are responsible for disclosing any known structural issues, roofing material sensitivities, existing electrical hazards, or access restrictions (locked gates, pets, alarm systems) prior to the scheduled installation date. Where a municipal permit or homeowners'-association approval is required for exterior lighting installation, obtaining that approval is the Customer's responsibility unless the Project Agreement states otherwise.

6. Payment Terms

Unless otherwise specified in your Project Agreement, a deposit of [insert deposit %, e.g., 50%] is due upon signing to reserve your installation date, with the balance due upon completion of installation. Accepted payment methods are listed in your Project Agreement. Late payments may be subject to interest at the maximum rate permitted under Ontario law and/or suspension of any warranty or ongoing service obligations until the account is brought current. All prices are in Canadian dollars and exclude applicable taxes unless stated otherwise.

7. Cancellation & Rescheduling

You may cancel or reschedule a confirmed installation by providing at least [insert notice period, e.g., 5 business days] written notice. Cancellations made with less notice, or a failure to provide site access on the scheduled date, may result in forfeiture of some or all of your deposit to cover materials already ordered and labor scheduled. Lumiform reserves the right to reschedule installations due to weather, safety concerns, or circumstances beyond our control, as described in Section 13 (Force Majeure), without penalty.

8. Warranty

Lumiform warrants its installation workmanship against defects for a period of [insert workmanship warranty period, e.g., 2 years] from the date of installation. LED fixtures and control hardware carry the manufacturer's warranty, details of which will be provided with your Project Agreement. This warranty does not cover damage caused by acts of God, improper use, unauthorized modification, third-party electrical work, or normal wear and tear. To make a warranty claim, contact us using the details in Section 17 (Contact). EXCEPT AS EXPRESSLY STATED IN THIS SECTION, THE SERVICES AND PRODUCTS ARE PROVIDED "AS IS" WITHOUT WARRANTIES OF ANY KIND, WHETHER EXPRESS OR IMPLIED, TO THE FULLEST EXTENT PERMITTED BY APPLICABLE LAW.

9. Customer Responsibilities

You agree to: (a) provide accurate contact, property, and payment information; (b) ensure your home's electrical system meets the requirements communicated by Lumiform prior to installation; (c) maintain a compatible Wi-Fi network for app-based control features, where applicable; and (d) avoid unauthorized modification, relocation, or servicing of installed lighting systems, as doing so may void applicable warranties.

10. Limitation of Liability

TO THE MAXIMUM EXTENT PERMITTED BY APPLICABLE LAW, LUMIFORM'S TOTAL LIABILITY ARISING OUT OF OR RELATED TO THE SERVICES OR THESE TERMS SHALL NOT EXCEED THE TOTAL AMOUNT PAID BY YOU FOR THE SERVICES GIVING RISE TO THE CLAIM. LUMIFORM SHALL NOT BE LIABLE FOR ANY INDIRECT, INCIDENTAL, SPECIAL, CONSEQUENTIAL, OR PUNITIVE DAMAGES, INCLUDING LOSS OF PROFITS, DATA, OR USE, ARISING FROM YOUR USE OF THE SITE OR SERVICES, EVEN IF ADVISED OF THE POSSIBILITY OF SUCH DAMAGES. NOTHING IN THESE TERMS EXCLUDES OR LIMITS LIABILITY THAT CANNOT BE EXCLUDED OR LIMITED UNDER APPLICABLE ONTARIO OR CANADIAN LAW, INCLUDING LIABILITY FOR GROSS NEGLIGENCE, WILLFUL MISCONDUCT, OR DEATH OR PERSONAL INJURY CAUSED BY NEGLIGENCE.

11. Indemnification

You agree to indemnify and hold harmless Lumiform, its owners, employees, and subcontractors from and against any claims, damages, liabilities, and expenses (including reasonable legal fees) arising from your breach of these Terms, misuse of the Site, or provision of inaccurate information about your property or its electrical systems.

12. Intellectual Property

All content on the Site — including text, graphics, logos, photographs, and video — is the property of Lumiform or its licensors and is protected by Canadian and international copyright and trademark law. You may not reproduce, distribute, or create derivative works from Site content without our prior written consent. Lumiform may photograph or video completed installations for portfolio, marketing, and website purposes; if you do not wish images of your property to be used this way, please notify us in writing prior to installation.

13. Force Majeure

Lumiform is not liable for any delay or failure to perform resulting from causes beyond our reasonable control, including severe weather, natural disasters, labor disputes, supply chain disruptions, or governmental action. Affected obligations will be performed as soon as reasonably practicable once the condition causing the delay has ceased.

14. Privacy

Information you submit through the Contact form or during a Project Agreement (such as your name, address, and email) is used solely to respond to your inquiry and deliver Services, in accordance with applicable Canadian privacy law (PIPEDA). Lumiform does not sell your personal information to third parties. [A separate, dedicated Privacy Policy is recommended and has not yet been drafted — ask if you'd like one built to sit alongside these Terms.]

15. Governing Law

These Terms are governed by the laws of the Province of Ontario and the federal laws of Canada applicable therein, without regard to conflict-of-law principles. You agree that any dispute arising from these Terms or the Services shall be subject to the exclusive jurisdiction of the courts located in Ottawa, Ontario.

16. Changes to These Terms

We may update these Terms from time to time to reflect changes in our Services or for legal or operational reasons. The "Last updated" date at the top of this page reflects the most recent revision. Continued use of the Site or Services after changes are posted constitutes acceptance of the revised Terms.
